Arbitration and mediation

Monegasque specificities in arbitration and mediation
The Code of Civil Procedure governs arbitration in civil and commercial matters.
Monaco is also party to the Geneva Protocol relating to Arbitration Clauses of 24 September 1923, and to the New York Convention on the Recognition and Enforcement of Arbitral Awards of 10 June 1958.
Monegasque legislation does not contain any general provision relating to judicial or contractual mediation.
Family mediation was introduced in the Civil Code by Law No. 1.336 of 12 July 2007, amended by Law No. 1.450 of 4 July 2017.
Mediation is a cause for suspension of the limitation period since Law No. 1.401 of 5 December 2013, whether it was agreed to use it by or without written agreement.
Arbitration and mediation, which are increasingly sought after by the Principality’s economic players, are destined to develop in Monaco.
