{"id":3961,"date":"2019-11-18T12:41:45","date_gmt":"2019-11-18T11:41:45","guid":{"rendered":"https:\/\/gbmlf.miam.dev\/?p=3961"},"modified":"2019-11-18T12:41:45","modified_gmt":"2019-11-18T11:41:45","slug":"sentence-law-reform","status":"publish","type":"post","link":"https:\/\/gbmlf.miam.dev\/en\/sentence-law-reform\/","title":{"rendered":"Sentence Law Reform"},"content":{"rendered":"<p>11\/2019<\/p>\n<p><strong><a href=\"https:\/\/journaldemonaco.gouv.mc\/Journaux\/2019\/Journal-8460\/Loi-n-1.478-du-12-novembre-2019-portant-modification-de-certaines-dispositions-relatives-aux-peines\">Act No. 1.478 of 12\/11\/2019 amending certain provisions relating to sentences<\/a>,<\/strong><strong> published in the <em>Journal de Monaco<\/em> on 15\/11\/2019, is the result of Bill No. 984, which incorporated Bill No. 224 on work in the public interest of the National Council as part of a comprehensive reform of law of sentencing. <\/strong><\/p>\n<p><strong>Act No.1.478, which is <em>\u201cpart of the Principality&#8217;s criminal policy&#8221;<\/em>, constitutes a major reform (99 articles) that modernizes the concept of the sentence: <em>&#8220;While striving to increase the tools for personalizing the sentence&#8221;, it &#8220;offers convicted persons better chances of reintegration, a sine qua non condition for preventing recidivism&#8221;<\/em>. <\/strong><a href=\"#_ftn1\" name=\"_ftnref1\"><strong>[1]<\/strong><\/a><strong> \u00a0<\/strong><\/p>\n<p><strong>It reinforces the freedom of assessment of the courts, which will have broader sanctions and better adapted to contemporary delinquency.<\/strong><\/p>\n<p><strong>Act No. 1.478 amends 16 texts, mainly the Criminal Code and the Code of Criminal Procedure.<\/strong><\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>MAJOR AXES OF THE REFORM:\u00a0\u00a0<\/strong><\/p>\n<p>\u2022 Modification of the range of sentences that may be imposed, in particular introduction of <strong>days-fine<\/strong> (an alternative to imprisonment) and <strong>community service<\/strong> (an alternative to imprisonment or fine).<\/p>\n<p>\u2022 Modification of the modalities of enforcement of sentences, in particular introduction of <strong>partial suspension<\/strong> (only part of the sentence is executed, the execution of the remaining sentence being temporarily suspended), <strong>period of day-parole<\/strong> and <strong>placement in society<\/strong> (adjustment of prison sentence, which allows the sentenced person to benefit from a special imprisonment regime with the authorization to leave the prison).<\/p>\n<p>\u2022 Clarification of the mechanism of <strong>sentences running concurrently<\/strong> (by which one sentence is deemed to be served at the same time as another, stronger sentence).<\/p>\n<p>\u2022 Clarification of procedural rules for <strong>default judgments<\/strong>.<\/p>\n<p>\u2022 New chapter on the <strong>residence ban<\/strong>.<\/p>\n<p>&nbsp;<\/p>\n<p><a href=\"#_ftnref1\" name=\"_ftn1\">[1]<\/a> Report on the Bill No. 984, amending certain provisions relating to sentences (Rapporteur on behalf of the Legislation Commission: Thomas BREZZO), 23\/10\/2019, p.1.<\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>11\/2019 Act No. 1.478 of 12\/11\/2019 amending certain provisions relating to sentences, published in the Journal de Monaco on 15\/11\/2019, is the result of Bill No. 984, which incorporated Bill [&hellip;]<\/p>\n","protected":false},"author":3,"featured_media":2920,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":[],"categories":[35],"tags":[],"acf":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v21.1 - https:\/\/yoast.com\/wordpress\/plugins\/seo\/ -->\n<title>Sentence Law Reform - Giaccardi &amp;
