{"id":4540,"date":"2021-01-01T12:29:21","date_gmt":"2021-01-01T11:29:21","guid":{"rendered":"https:\/\/gbmlf.miam.dev\/?p=4540"},"modified":"2021-01-04T17:37:05","modified_gmt":"2021-01-04T16:37:05","slug":"development-in-monegasque-legal-framework-against-money-laundering-corruption-and-financing-of-terrorism-law-no-1503","status":"publish","type":"post","link":"https:\/\/gbmlf.miam.dev\/en\/development-in-monegasque-legal-framework-against-money-laundering-corruption-and-financing-of-terrorism-law-no-1503\/","title":{"rendered":"Modification of Monegasque legal framework against money laundering, corruption and financing of terrorism (Law 1.503)"},"content":{"rendered":"<p><strong>Law No. 1.503 of 23 December 2020 strengthening the AML\/CFT\/CO provisions<\/strong>, published in the Journal de Monaco n\u00b0 8519 of 01\/01\/2021, is the result of Bill n\u00b0 1008 voted in the Public Legislative Session of 16 December 2020. <strong>[1]\u00a0<\/strong><\/p>\n<p><strong>The draft government text was amended by the Legislation Committee of the National Council and consolidated.<\/strong><span style=\"color: #ff9900;\"><strong>\u00a0\u00a0<\/strong><\/span><\/p>\n<p><strong>The entry into force is spread out depending on the provisions until 31 December 2021.<\/strong><\/p>\n<p><strong><u>Legal framework amended by Law No. 1.503<\/u><\/strong><strong>:<\/strong><\/p>\n<ul>\n<li>Act 1.362 of 3 August 2009 on the fight against money laundering, terrorist financing and corruption, as amended<\/li>\n<li>Act No. 214 of 27 February 1936 amending Law No. 207 of 12 July 1935 on trusts, as amended<\/li>\n<li>Act No. 797 of 18 February 1966 on civil societies, as amended<\/li>\n<li>Criminal Code<\/li>\n<li>Criminal Procedure Code<\/li>\n<\/ul>\n<p><strong><u>Purpose of Bill No. 1008<\/u><\/strong><strong>:<\/strong><\/p>\n<p><strong style=\"color: #ff6600;\">\u2192 To adjust and complete the AML\/CFT framework to fully comply with the FATF Recommendations and the European Union&#8217;s &#8220;4th Anti-Money Laundering Directive&#8221; (Directive (EU) 2015\/849)[2].<\/strong><\/p>\n<p><span style=\"color: #ff6600;\"><strong>\u2192 To transpose [2] the &#8220;5th Anti-Money Laundering Directive&#8221; of the European Union (EU Directive 2018\/843)[3], whose implementation deadline in Monaco has been set for 31 December 2020.<\/strong><\/span><\/p>\n<p><strong>\u00a0<\/strong>The &#8220;5th Directive&#8221; complements and reinforces the provisions of the &#8220;4th Directive&#8221;:<\/p>\n<p>\u2022 Extension of the scope of persons subject to the AML\/CFT legal framework <strong>&gt;<\/strong> <strong>providers of online payment and e-money services<\/strong>;<\/p>\n<p>\u2022 Clarifications concerning business <strong>relationships and envisaged transactions involving a high-risk third country<\/strong> (collection of additional information and possibility to provide for additional measures: prohibition on establishing subsidiaries in that country, systematic reporting, etc.);<\/p>\n<p>\u2022 Establishment of <strong>consolidated supervision of banking and insurance groups<\/strong> (clarification of the degrees of intervention by the supervisory authorities of the parent undertaking and its subsidiaries\/branches, specific policies for procedures relating to intra-group exchanges of information);<\/p>\n<p>\u2022 Obligation to collect evidence of registration or an extract from the Register of <strong>Beneficial Owners of Legal Entities<\/strong> when entering into a relationship, and to declare any discrepancies between the information that is held and that recorded in the Register;<\/p>\n<p>\u2022 Establishment of a <strong>standardised list of functions regarding \u201cPolitically Exposed Person (PEP)<\/strong>\u201d.<\/p>\n<p><strong style=\"color: #ff6600;\">\u2192 To take into account the changes in European Union legislation on the cross-border transportation of cash introduced by Regulation (EU) 2018\/1672 of 23 October 2018<\/strong> <strong style=\"color: #ff6600;\">[4], the deadline for implementation in Monaco being 31 December 2021<\/strong><\/p>\n<p>European legislation broadens the legal definition of &#8220;cash&#8221;, which includes : currency (banknotes and coins); bearer negotiable instruments (travellers&#8217; cheques, cheques, promissory notes or money orders), commodities used as highly-liquid stores of value (coins with a gold content of at least 90\u00a0%;\u00a0bullion such as bars, nuggets or clumps with a gold content of at least 99,5\u00a0%; prepaid cards.<\/p>\n<p>1] Bill No. 1008 (90 articles)\u00a0 [1] was received by the National Council on 12 February 2020 and tabled in public session on 6 April 2020.<\/p>\n<p>2] Directive (EU) 2015\/849 of the European Parliament and of the Council of 20 May 2015 on the prevention of the use of the financial system for the purpose of money laundering or terrorist financing, amending Regulation (EU) No 648\/2012 of the European Parliament and of the Council and repealing Directive 2005\/60\/EC of the European Parliament and of the Council and Commission Directive 2006\/70\/EC.<\/p>\n<p>Pursuant to Article 11(4) of the Monetary Agreement of 29 November 2011 between the Principality of Monaco and the European Union, made enforceable by Sovereign Order 3.559 of 5 December 2011, <em>&#8220;The Principality of Monaco shall adopt measures equivalent to those taken by the Member States in application of the Union acts necessary for the implementation of this Agreement and listed in Annex B&#8221;. \u00bb<\/em>.<\/p>\n<p>3] Directive (EU) 2018\/843 of the European Parliament and of the Council of 30 May 2018 amending Directive (EU) 2015\/849 on the prevention of the use of the financial system for the purposes of money laundering or terrorist financing, and amending Directives 2009\/138\/EC and 2013\/36\/EU.<\/p>\n<p>4] Regulation (EU) 2018\/1672 of the European Parliament and of the Council of 23 October 2018 on controls on cash entering or leaving the Union and repealing Regulation (EC) No 1889\/2005.<\/p>\n<h6><\/h6>\n","protected":false},"excerpt":{"rendered":"<p>Law No. 1.503 of 23 December 2020 strengthening the AML\/CFT\/CO provisions, published in the Journal de Monaco n\u00b0 8519 of 01\/01\/2021, is the result of Bill n\u00b0 1008 voted in [&hellip;]<\/p>\n","protected":false},"author":3,"featured_media":4537,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":[],"categories":[35],"tags":[],"acf":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v21.1 - https:\/\/yoast.com\/wordpress\/plugins\/seo\/ -->\n<title>Modification of Monegasque legal framework against money laundering, corruption and financing of terrorism (Law 1.503) - Giaccardi &amp;
