duration of implicit freezing decisions by the Minister of State; designations of persons and entities made by the Minister of State);<\/li>\n<li>provisions relating to the <strong>exchange of information<\/strong>;<\/li>\n<li><strong>specific provisions<\/strong> on restrictive measures adopted by the European Union in respect of actions undermining or threatening the territorial integrity, sovereignty and independence of <strong>Ukraine.<\/strong><\/li>\n<\/ul>\n<p>Reference text: <strong>Sovereign Order 9.533 of 7 November 2022<\/strong> (JDM 8616 of 11 November 2022).<\/p>\n<hr \/>\n<p><span style=\"color: #ff6600;\"><strong>Reform of co-ownership: publication of the Ministerial Order for the application of Articles 12 and 21 of\u00a0 Law 1.329<\/strong><\/span><\/p>\n<p>When the assembly is called upon to deliberate on the question of works or expenses, estimates must be attached to the convocation, if the <strong>amount of the works<\/strong> is greater than :<\/p>\n<ul>\n<li>10,000 \u20ac when the building has less than ten main lots;<\/li>\n<li>20,000 \u20ac when the building has ten to twenty main lots;<\/li>\n<li>50,000 \u20ac when the building has more than twenty main lots.<\/li>\n<\/ul>\n<p>The Ministerial Order also sets out :<\/p>\n<ul>\n<li>the (non-exhaustive) list of the <strong>building&#8217;s documentation<\/strong> (which includes the essential financial and technical data relating to the co-ownership and its building) that the <strong><em>syndic<\/em> <\/strong>must draw up and keep up to date;<\/li>\n<li>the (minimum) list of <strong>documents<\/strong> that the <strong><em>professional syndic<\/em> <\/strong>makes available in the <strong>secure online space<\/strong> accessible to all co-owners.<\/li>\n<\/ul>\n<p>Reference text: <strong>Ministerial Order 2022-588 of 8 November 2022<\/strong> (JDM 8616 of 11 November 2022).<\/p>\n<hr \/>\n<p><span style=\"color: #ff6600;\"><strong>Usury rate for home loans to individuals revised upwards again<\/strong><\/span><\/p>\n<p>The average rate charged by lenders is thus set at :<\/p>\n<p>&#8211; For individuals :<\/p>\n<ul>\n<li>Overdrafts: 14.88% (unchanged)<\/li>\n<li>Personal loans: 3.32% (unchanged)<\/li>\n<li><strong>Home loans:<\/strong> increased from 2.13% <strong>to 2.49%<\/strong><\/li>\n<\/ul>\n<p>&#8211; Public session of 30 November 2022<\/strong><\/span><\/p>\n<p><strong><span style=\"color: #ff6600;\">1. Alternative measures to prosecution, preliminary investigation<\/span><\/strong><\/p>\n<p>The main contributions of the voted <strong>Bill 1030<\/strong> (received by the <em>Conseil National<\/em> on 9 April 2021) are the following:<\/p>\n<ul>\n<li>Introduction of <strong>alternative measures<\/strong> <strong>to prosecution<\/strong> (directing the offender to a health, social or professional structure, penal mediation, removal measures, etc.);<\/li>\n<li>Adjustment of the <strong>police custody<\/strong> (<em>garde \u00e0 vue<\/em>) regime (guarantees in the event of extension, full body search);<\/li>\n<li>Establishment of the <strong>free hearing <\/strong>(<em>audition libre<\/em>);<\/li>\n<li>Framing of the <strong>preliminary investigation<\/strong> (the most substantial contribution of Bill 1030).<\/li>\n<\/ul>\n<p><strong><span style=\"color: #ff6600;\">2. Investigation (<em>instruction<\/em>), appeal for review (<em>pourvoi en r\u00e9vision<\/em>) in criminal matters<\/span><\/strong><\/p>\n<p>The main purpose of <strong>Bill 1031<\/strong> (submitted to the <em>Conseil National<\/em> on 9 April 2021) is to reform the pre-trial investigation procedure in terms of the guarantees afforded to the accused under the European Convention on Human Rights:<\/p>\n<ul>\n<li>Strengthening the <strong>adversarial process<\/strong> and the <strong>interaction<\/strong> between the investigating judge, the civil parties and the defendants;<\/li>\n<li>Stricter supervision of <strong>searches carried out on the premises<\/strong> of persons who are granted specific protection because of their professional activity;<\/li>\n<li>Possibility for the investigating judge to use <strong>real-time geolocation<\/strong> of a person on the territory of the Principality;<\/li>\n<li>Creation of the status of <strong>assisted witness <\/strong>(<em>t\u00e9moin assist\u00e9<\/em>) ;<\/li>\n<li>Organisation of the presence of the lawyer during the <strong>first appearance examination <\/strong>(<em>interrogatoire de premi\u00e8re comparution<\/em>);<\/li>\n<li>Overhaul of the <strong>nullity<\/strong> procedures and purge of nullities.<\/li>\n<\/ul>\n<p>It also makes adjustments to the <strong>appeal for review<\/strong> with regard to equality of arms and the liability of legal persons.<\/p>\n<p><span style=\"color: #ff6600;\"><strong>3. International mutual legal assistance (<em>entraide judiciaire internationale<\/em>)<\/strong><\/span><\/p>\n<p>The purpose of <strong>Bill 1068 <\/strong>voted (received by the <em>Conseil National<\/em> on 3 November 2022) is to comply with the 37th Recommendation &#8211; Mutual Legal Assistance of the Financial Action Task Force (FATF) and to strengthen Monaco&#8217;s international cooperation in criminal matters.<\/p>\n<p>The term &#8220;<em>commission rogatoire<\/em>&#8221; is replaced by &#8220;request for mutual assistance&#8221; (<em>&#8220;demande d&#8217;entraide&#8221;<\/em>).<\/p>\n<p>The ordinary law of the international mutual assistance regime (in the absence of an international convention stipulating otherwise) is modified with regard to the following aspects:<\/p>\n<ul>\n<li><strong>Control of the<\/strong> <strong>transmission and execution<\/strong> of foreign requests for mutual assistance;<\/li>\n<li>Possibilities of <strong>appeal against measures executed on Monegasque territory i<\/strong>n application of a foreign request for mutual assistance;<\/li>\n<li><strong>Transmission of documents<\/strong> for the execution of a request for mutual assistance to the authority of the requesting State.<\/li>\n<\/ul>\n<p><strong><span style=\"color: #ff6600;\">4. Seizure and confiscation of instruments and proceeds of crime<\/span><\/strong><\/p>\n<p><strong>Bill 1067<\/strong> voted (received by the <em>Conseil National<\/em> on 3 November 2022) transcribes:<\/p>\n<ul>\n<li><strong>Directive 2014\/42\/EU of 3 April 2014<\/strong> on the freezing and confiscation of instrumentalities and the proceeds of crime in the European Union concerning counterfeiting currency, fraud and counterfeiting of non-cash means of payment, money laundering, and terrorism (in application of the Monetary Agreement of 29 November 2011 with the European Union);<\/li>\n<li>the <strong>FATF International Recommendations<\/strong> (taking into account the observations of the\u00a0 MONEYVAL Committee of the Council of Europe made in the context of the 5th evaluation cycle of Monaco).<\/li>\n<\/ul>\n<p>The main thrusts of the reform are as follows:<\/p>\n<ul>\n<li>Clarification of the <strong>ordinary confiscation penalty<\/strong> (confiscation of mixed proceeds, value confiscation and registration formalities);<\/li>\n<li>Creation of <strong>specialised money laundering assistants<\/strong> to provide magistrates with additional technical expertise;<\/li>\n<li>Extension of the seizure of property liable to confiscation to <strong>all underlying offences<\/strong>;<\/li>\n<li>Extension of the tasks of judicial police officers to the <strong>detection and tracing of confiscable assets<\/strong>;<\/li>\n<li>Reinforcement of <strong>procedural guarantees<\/strong> for persons affected by a seizure or confiscation order;<\/li>\n<li>Creation of a <strong>management service for seized or confiscated assets <\/strong>(<em>&#8220;service de gestion des avoirs saisis ou confisqu\u00e9s&#8221;<\/em>), placed under the authority of the Director of Judicial Services, responsible for disposing of, allocating free of charge, or destroying them, if necessary.<\/li>\n<\/ul>\n<p><strong><span style=\"color: #ff6600;\">5. Submission of the domiciliation activity to the anti-money laundering and terrorist financing provisions<\/span><\/strong><\/p>\n<p><strong>Bill 1072 <\/strong>voted (received by the <em>Conseil National <\/em>on 24 November 2022) subjects to Law 1. 362 <em>&#8220;<strong>30\u00b0) persons who, on a regular basis, carry out the activity of domiciliation<\/strong> consisting of providing third parties with a registered office, a business address or premises, an administrative or postal address for a capital company, a partnership or any legal person or entity, in addition to the ancillary services of renting offices or meeting rooms, administrative assistance linked to the activity of domiciliation, with the exception of the exercise of any regulated activities.&#8221;<\/em><\/p>\n<p>The activity of domiciliation is currently subject to Law 1.362 when it is included <strong>among the activities<\/strong> offered by <em>&#8220;persons who habitually carry out operations of creation, management and administration of legal persons, legal entities or trusts, in favour of third parties&#8221;<\/em> referred to in point 6\u00b0) of Article 1.<\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>#assetsfreezing #banking #financial #AML\/FT-Corr #company #criminal #procedure #justice #realestate #urbanism #international #FATF #MONEYVAL #EU We are pleased to propose a summary of the legal news in Monaco in November 2022.\u00a0 [&hellip;]<\/p>\n","protected":false},"author":3,"featured_media":8478,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":[],"categories":[38],"tags":[],"acf":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v21.1 - https:\/\/yoast.com\/wordpress\/plugins\/seo\/ -->\n<title>Monaco Legal News Overview \u2013 November 2022 - Giaccardi &amp;
